  1. Introduction

These Terms & Conditions (“Terms”) form the agreement between Every Event Co – Scottish Borders (“we”, “our”, “us”) and the Client (“you”, “your”). By paying a deposit or booking fee, you accept these Terms in full.

Our priority is safety, professionalism, and providing high-quality event hire. These Terms protect both you as the hirer and us as the provider.

  1. Bookings & Payments
  • A non-refundable deposit is required to secure your booking.
  • Bookings are not confirmed until the deposit is received and Every Event Co issues confirmation.
  • The full balance must be paid no later than 14 days before your booking date.
  • If the balance is not paid by this deadline, your booking will be cancelled without refund, and your date may be released to another client.
  • All payments made (including deposits and balances) are strictly non-refundable.

    Online "Ordering / Booking"

    • By placing an "order" through our website ( www.every-event-co.co.uk ), you agree to provide accurate, complete, and current information for all transactions.

    • All "orders / Bookings" are subject to acceptance and availability. We reserve the right to refuse or cancel any order for any reason, including product or service unavailability, errors in pricing or description, or suspected fraudulent activity.

    • Payment in full is required at the time of ordering/booking unless otherwise stated.

    • Prices displayed on our website strictly exclude delivery and setup fees. You, the client, are entirely responsible for covering these costs. Delivery and setup fees will be calculated after your order is placed, along with confirmation of your required date, and we will issue a further invoice to cover these charges - this is subject to our other terms and must be paid in full no later than 14 days prior to your scheduled event.

    • If your requested date is not available, we will endeavour to work with you to arrange an alternative date where possible.


  1. Cancellations & Refunds
  • All payments (deposit and balance) are non-refundable under any circumstances.
  • If you cancel your booking for any reason, all monies paid will be forfeited.
  • If we cancel your booking (e.g. due to staff illness, vehicle breakdown, or equipment fault), we will:
    • Offer a transfer to another date, or
    • Issue a credit note for future use.
  • Bouncy Castle Weather Policy: If high winds (above 18 mph), heavy rain, snow, or unsafe weather prevents set-up, we must cancel for safety.
    • In this case, we will offer you a rescheduled date. Refunds will not be given.

  1. Delivery, Set-Up & Collection
  • Delivery and collection times will be agreed prior to your event.
  • You must provide:
    • Safe, unobstructed access for our team and vehicle.
    • Adequate space for the equipment (measurements can be provided at time of booking).
    • A flat, clean, dry, and safe area for set-up (indoors or outdoors).
  • Soft Play must always be set up on a clean, dry, flat surface.
    • Grass areas are acceptable – Preferably dry.
    • Damp muddy areas are not acceptable.
    • Areas where animals have access or use as a toilet will not be set up upon under any circumstances.
  • Bouncy Castles must be set up on flat, dry grass or inside a venue, unless otherwise agreed in writing, with appropriate anchoring:
    • Indoors: secured with multiple 25kg sandbags.
    • Outdoors: secured with 2ft long metal tie-down stakes/pegs.
  • Should the wind speed exceed 16mph, Every Event Co reserves the right to refuse or withdraw set-up for safety reasons. In these cases:
    • We will work with the Client to re-book or set up in another suitable location if available.
    • We strongly recommend clients arrange a backup indoor venue wherever possible.
  • If we arrive and the area is unsuitable, unsafe, or access is blocked, we may refuse set-up — and no refund will be given.
  • Should it rain, it is the Client’s responsibility to immediately:
    • Turn off and disconnect all electrical equipment from mains power – including blowers, extension leads, and speakers.
    • Cover the equipment where possible and ensure items are dried safely before further use.

  1. Hire Period
  • Hire covers the time stated in your booking confirmation.
  • If you delay collection (e.g. venue not ready to release equipment), you may incur additional fees.
  • Overnight hire is only permitted by prior written agreement and may carry an extra charge.

 

  1. Client Responsibilities

By booking, you accept responsibility for:

  • Supervising all equipment at all times (a responsible adult aged 18+ must supervise)
  • Ensuring users follow safety instructions provided by Every Event Co.
  • Preventing use by anyone exceeding weight/age limits (provided in advance).
  • Ensuring no food, drink, face paint, glitter, chewing gum, pets, or sharp objects are allowed on or near the equipment.
  • Ensuring users remove shoes, jewellery, and sharp accessories before use.
  • Stopping use immediately if weather turns unsafe (e.g. strong wind for inflatables, Rain whilst electrical equipment is turned on and so on).

  1. Damage, Cleaning & Replacement Costs
  • All equipment is checked, cleaned, and sanitised before each hire. When the hire period ends, it is expected that the equipment will be returned in a similar clean and reasonable condition.
  • Excessive dirt or staining – including but not limited to mud, face paint, glitter, chewing gum, food, drinks, animal mess, or any other substance – will result in a cleaning charge.
  • Our cleaning rate is £30.00 per hour, per person, plus the cost of any specialist cleaning products or treatments required to return the equipment to a hireable condition.
  • Where an item cannot be sufficiently cleaned or restored to its original condition, the full replacement cost of the item will be charged to the Client.
  • Examples of chargeable issues include (but are not limited to):
    • Soft play items soiled with mud, sticky drinks, face paints, or food.
    • Bouncy castles returned excessively dirty or marked.
    • Items contaminated by animal waste, vomit, or other biohazards.
  • Cleaning fees will be itemised and invoiced after the event if required. If replacement is necessary, the Client will be invoiced for the full retail cost of the item, plus any delivery charges incurred to obtain replacements promptly.

 

  1. Safety Guidelines
  • Bouncy castles must not be used by adults unless specifically stated as suitable.
  • Maximum user numbers and age/weight limits must be adhered to.
  • Equipment must not be moved once installed by our team.
  • If strong winds or unsafe weather occur during hire, you must immediately stop use and deflate the bouncy castle. Unplug any electrical equipment individually and at the mains source, cover electrical equipment and move safely to cover. Dry unplugged items where possible.
  • Electrical equipment (e.g. blowers) must remain dry and must not be tampered with.
  • All our equipment is P.A.T. Tested, Our bouncy castles are P.I.P.A tested. Documentation / Proof can be provided upon request.

  1. Liability
  • Every Event Co holds full Public Liability Insurance to cover our services and equipment in the unlikely event of proven negligence on our part.
  • However, this insurance does NOT cover:
    • Injuries or accidents resulting from misuse of equipment (e.g., not following safety rules, overloading items, or using equipment for purposes other than intended).
    • Injuries or accidents resulting from lack of supervision — all equipment must be monitored by a responsible adult (18+) at all times.
    • Any harm caused by deliberate or reckless behaviour by users, guests, or members of the public.
    • Damage or injury caused by ignoring safety instructions provided verbally, in writing, or on the safety signage displayed on equipment.
  • Client Responsibility for Safety:
    • From the moment equipment is set up, the Client assumes full responsibility for its safe use and for ensuring that all users are supervised and follow the safety rules provided by Every Event Co.
    • The Client is responsible for ensuring the setup area remains safe and secure during the hire period — this includes keeping pets, sharp objects, and hazards away from the equipment.
  • Equipment Movement & Tampering:
    • Once set up, equipment must not be moved, or re-positioned by the Client or guests.
    • Any tampering with blowers, extension leads, anchoring systems, or other safety features voids liability coverage.
  • Limits of Liability:
    • Every Event Co is not liable for loss, injury, or damage to persons or property caused by misuse, negligence, or failure to follow instructions during the hire period.
    • Every Event Co is not liable for delays, cancellations, or loss of enjoyment caused by factors outside of our control (e.g. weather conditions, road closures, or venue restrictions).
    • Our total liability under any circumstances shall not exceed the total amount paid for the hire.
  • Third-Party or Venue Liability:
    • It is the Client’s responsibility to ensure that the venue hired for the event allows the safe use of the equipment and complies with local regulations.
    • Any damage caused to the venue, its property, or third-party property during the hire period is the Client’s responsibility, not Every Event Co’s, unless proven negligent on our part.

  1. Force Majeure

We are not responsible for cancellations, delays, or non-performance caused by events beyond our control, including:

  • Severe weather
  • Natural disasters
  • Road closures or accidents
  • Staff illness or emergencies

In such cases, we will offer to reschedule your booking but refunds will not be issued.

  1. Photography & Marketing
  • We may take photographs or videos of set-ups for marketing purposes (social media, website, brochures) unless you request otherwise in writing before the event.
  • We will never use photos of guests without prior consent.

  1. Data Protection
  • All personal data will be handled in accordance with GDPR.
  • Your information is stored securely and will never be shared except for essential booking purposes.

  1. Governing Law

These Terms & Conditions are governed by Scottish law. Any disputes will be handled exclusively in the Scottish courts.

  1. Acceptance of Terms

By booking and paying a deposit, you confirm you:

  • Have read and fully understood these Terms & Conditions.
  • Agree to abide by them for the duration of your hire.
  • Accept responsibility for all hired items during the hire period.

 


Acceptance of Terms

By booking with Every Event Co – Scottish Borders and paying a deposit, you (the Client) acknowledge that you are entering into a legally binding agreement with Every Event Co and agree to the following:

-You have read, understood, and fully accept these Terms & Conditions in their entirety. You understand that they outline your responsibilities as the hirer and the responsibilities and limits of liability of Every Event Co.

-You agree to abide by these Terms & Conditions for the entire duration of your hire. This includes following all safety guidance and instructions provided verbally, in writing, or displayed on signage on the equipment.

-You accept full responsibility for all hired items from the time of delivery and set-up until the time Every Event Co collects them. This includes ensuring that the items are not damaged, misused, stolen, or exposed to conditions that may cause harm to them (e.g., water damage, animal waste, sharp objects).

-You agree to provide appropriate supervision at all times – a responsible adult aged 18+ must monitor all equipment while in use. You understand that failure to supervise may result in injury, damage, or additional charges, for which you will be held liable.

-You take full liability for any loss, theft, or damage to any equipment during your hire period, whether caused by guests, children, pets, or members of the public, and you agree to cover all costs for repair, cleaning, or replacement as required.

-You understand that payment of the deposit and/or balance confirms acceptance of these Terms.Once payment is made, these Terms & Conditions are considered legally binding, and failure to comply may result in additional fees or legal action where necessary.

-You accept that Every Event Co reserves the right to refuse set-up or remove equipment if conditions are unsafe, unsuitable, or if Terms & Conditions are breached – and that in such cases, no refund will be given.

-You confirm that you have the authority to enter into this agreement on behalf of the hirer (e.g., if booking for a venue, organisation, or group) and that all information provided is accurate and truthful.
